TERMS OF USE – hiSofi
1. About the Platform
hiSofi provides a digital platform that allows users to identify outstanding debts with partner creditors and access negotiation and payment options, under conditions defined directly by such creditors.
hiSofi acts as a technological intermediary between creditors and users, enabling communication, negotiation, and payment of financial obligations, without interfering with the commercial terms originally established between the parties.
2. hiSofi's Role
hiSofi may act:
as Controller, in the processing of personal data arising from browsing and direct use of the portal; and
as Processor, when processing personal data on behalf of contracting creditors, in the context of providing communication and collection management services.
Negotiation terms, amounts, discounts, and payment methods are established exclusively by the creditors and are not defined or changed by hiSofi.
3. Registration and Platform Use
Access to certain platform features may require prior user registration.
The user declares that:
has legal capacity to use the services;
will provide true, up-to-date, and complete information;
will keep their access credentials confidential.
Improper use of the platform may result in suspension or deletion of the user's account.
4. Communications
By using the platform, the user acknowledges that they may receive communications related to debts, negotiations, or payments through:
telephone
SMS
messaging apps
portal notifications
Such communications may occur on behalf of partner creditors, according to their instructions and applicable law.
5. Platform Availability
hiSofi will use its best efforts to ensure platform availability and security.
Temporary unavailability may occur due to:
technical maintenance;
third-party failures;
events beyond hiSofi's reasonable control.
6. Liability
hiSofi is not a party to the credit relationship between user and creditor and is solely responsible for providing the technological platform.
The creditor remains responsible for:
validity of the debt;
definition of negotiation terms;
payment settlement;
issuance of documents related to the obligation.
hiSofi's liability for potential damages arising from platform use is limited to direct damages demonstrably caused by its actions, except in cases of willful misconduct or gross negligence.
7. Information Security
hiSofi adopts appropriate technical and administrative measures to protect the personal data processed, as described in its Privacy Policy.
8. Intellectual Property
All rights related to the hiSofi platform, including software, trademark, layout, databases, and content, are the exclusive property of hiSofi or its licensors.
Reproduction, modification, or reverse engineering of the platform is prohibited without prior express authorization.
9. External Links
The platform may contain links to third-party websites, whose use is governed by their own terms and privacy policies.
hiSofi is not responsible for the content or practices of such environments.
10. Updates
These Terms may be updated at any time by publication on the portal.
11. Applicable Law
These Terms are governed by Brazilian law, and the courts of São Paulo/SP are elected to settle any disputes.
